Generally

SMOWE GmbH, located at Novalisweg 24h, 22303 Hamburg, offers the customer a limited-time manufacturer's warranty for its products subject to the following conditions and to the extent described below. This manufacturer's warranty applies in addition to the statutory warranty provisions, such as those stipulated in the Product Liability Act. It is not affected by cases of intent or gross negligence, or in cases of injury to life, limb, or health caused by SMOWE GmbH or its agents.

Our products are made from high-quality materials and manufactured using state-of-the-art processes. This makes them exceptionally durable, sustainable, and water- and odor-resistant. They are also dishwasher-safe. Although we conduct strict quality controls and tests, we unfortunately cannot guarantee that defects will not occur in individual cases. However, if one of our products exhibits such a defect, we provide the following manufacturer's warranty under certain conditions, in addition to the statutory warranty to which the consumer is entitled against the seller.

For the purposes of this manufacturer's warranty, a consumer is defined as any natural person who is in possession of the product and has not acquired it for private resale or to sell it to third parties in the course of their commercial or independent professional activities.

Scope of warranty

The warranty conditions are limited to the territory of the Federal Republic of Germany and the European Union. They are valid for all products purchased from December 4, 2023 (as shown on the receipt). SMOWE GmbH warrants that its products are waterproof, odor-proof, and dishwasher-safe. Product liability claims are only possible in accordance with statutory provisions. This warranty covers defects that are undoubtedly due to material defects. However, it does not apply to the film hinge on the lid, as this can break if handled improperly.

The warranty period for our products is five months from the date of purchase. If the product is defective upon delivery and unused, please notify our support team immediately upon receipt. In such a case, we will arrange for a replacement delivery immediately. Only one complaint is possible for each product per order. Duplicate entries in the complaint form for the same product under the same order number cannot be processed.

SMOWE GmbH reserves the right to offer a refund or partial refund of the purchase price. The services listed here supplement the statutory warranties and do not limit or replace them. This guarantee represents a voluntary and non-binding service provided by SMOWE GmbH, which may be rejected at any time without giving reasons.

Excluded circumstances of the guarantee

Goodwill services: Gifts and goodwill services provided to the customer are not covered by a warranty. A warranty requires a purchase for which the customer has provided consideration.

Purchase from third parties: When purchasing SMOWE products from third parties, there is no warranty claim.

Gifted products: Products given away as part of promotional gifts and collaborations are excluded from the guarantee.

Products purchased more than 5 months ago are generally excluded from the warranty.

Claiming the guarantee

To claim your warranty, please send us a message using the contact form . After receiving your message, we will inform you about the next steps. If the warranty claim is processed, returns within Germany are free of charge.

Required documentation

In order to make a warranty claim, it is necessary to provide photos in which the underlying defect is clearly visible.

Replacement for a product that has already been replaced

A claim for a replacement product already received is only valid if the "replacement for replacement" claim was made within six months of the purchase date. This renewed claim can only be made if the defect results in fewer intact units of the replaced product than the customer originally received with the initial order. In other words, we will only replace products again if the defect results in fewer intact units than the original order.

Preclusion period and limitation period

Warranty claims must be asserted immediately, but no later than one month after the discovery of a defect. After this period, warranty claims are excluded. Warranty claims expire five months after the end of the warranty period.

Disclaimer

This warranty does not include any liability for consequential damages of any kind or other compensation claims. This limitation does not apply to mandatory statutory provisions that impose liability on the manufacturer outside of this voluntary warranty.

Note on the guarantee promise according to § 477 BGB

Regardless of this manufacturer's warranty and regardless of whether or not a warranty claim is asserted in the event of a defect, the consumer's statutory warranty rights against the respective seller remain unconditionally valid. Therefore, the consumer may, at his or her own discretion, assert the statutory rights with regard to defects in the purchased product, including subsequent performance, withdrawal, price reduction, or compensation (see Section 437 of the German Civil Code), as well as the corresponding limitation periods pursuant to Section 438 of the German Civil Code, without having to invoke the warranty claims. This warranty does not affect mandatory statutory liability provisions.
